1. DEFINITIONS:
1.1 ‘Us/We/Our/Contractor’ means 230 VOLTS
1.2 ‘Electrician/Trainee/Tradesperson/Tradespersons/Contractor’ refers to the representative(s) appointed by 230 VOLTS to carry out work.
1.3 ‘Customer’ shall mean the client, person, company or firm responsible for instructing the works.
1.4 ‘Property/Premise’ shall mean place of work or place where works is carried out, domestic/commercial.
1.4 ‘Works/Remedial Works’ shall mean those works described in an quote/estimated quote.
1.5 ‘Services’ means service provided by us to you.
1.6 ‘Normal Working Hours’ means between 8am and 4.00pm Monday to Friday.
1.7 ‘Order’ means an order for a Service made by you in accordance with these Terms.
1.8 ‘Confirmation’ means our written acceptance of your Order.
1.9 ‘Working Days’ means Monday to Friday, excluding Bank or other Public holidays
1.10 ‘Next Working Day’ means a day of the week excluding Bank or other Public holidays
not including Saturday and Sunday.
1.11 ‘Actual Quote/Fixed Price/Fixed Fee’ means a set price given to the service offered.
1.12 ‘Day Rate’ means a set amount charged during normal working hours. Day rate charge per electrician this excludes any materials.
1.13 ‘Hourly Rate’ means a set amount charged every hour. Hourly rate charge per electrician, this excludes any materials.
1.14 ‘Emergency Call Out’ means a set amount charged per hour for us to attend to carry out an investigation.
1.15 ‘Price’ shall mean the Price of the Works as agreed between the Company and the Customer.
1.16 ‘Estimated Quote’ shall mean an estimate of the cost of works/Labor and shall not mean actual cost of carrying out works under this contract.
1.17 ‘BS7671’ means British Standards wiring regulations ( current versions only apply )
1.18 ‘GN3’ means Guidance note 3 which expands upon BS7671 part 6 inspection and testing
1.19 ‘E.I.C.’ means electrical installation certificate.
1.20 ‘E.I.C.R’ means electrical installation condition report.
1.21 ‘M.W.C’ means minor works certificate.
1.22 ‘P.A.T’ means portable appliance testing.
1.23 ‘CU’ means consumer unit.
1.24 ‘DB’ means Distribution Board.
1.25 ‘Fusebox’ the correct term is consumer unit.
1.26 ‘Domestic’ means Domestic Property a building or self-contained part of a building which is used wholly for the purposes of living accommodation’ consisting of a single phase electrical supply and consumer unit.
1.27 ‘Commercial’ means Commercial Property any property that is used for the purposes of making a profit, as well as any form of business activity’ consisting of a three phase and/or single phase electrical supply and consumer units/distribution Board.
2. ACCEPTANCE:
2.1 Any instructions received by the company from the customer for the supply of works and/or the customer’s acceptance of works undertaken by the company shall constitute acceptance of the terms and conditions contained herein.
2.2 Where more than one customer has entered into this agreement, the customers shall be jointly and severally liable for all payments of the Price.
2.3 Upon acceptance of these terms and conditions by the customer, the terms and conditions are irrevocable and can only be rescinded in accordance with these terms and conditions or with the written consent of the company.
2.4 None of the company’s agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the manager of the company in writing nor is the company bound by any such unauthorised statements. Unless otherwise expressly agreed in writing by both parties. A quote or estimated quote remains open for 28 days for acceptance unless previously withdrawn. Thereafter it is subject to confirmation or adjustment by the contractor.
2.5 Before any electrical works/electrical inspections are carried out on existing electrical installations, we are in belief that the electrical installation is installed to a satisfactory condition and to the current version of BS7671, the fabric of the building also is in good/safe workable condition.
2.6 All past and present available documents would need to be produced ie. electrical documents, asbestos reports, drawings, plans, schedule of works. Documents in regards to health and safety ie asbestos reports that cannot be produced one shall be required of the welfare of us.
2.6 It is your responsibility to ensure their is parking available for us. Residential parking permits or bays must be provided if the property to be inspected or have works done is within a restricted parking zone.
2.7 We reserve the right to refuse or decline to undertake any work. We reserve the right, at our absolute discretion, to designate the tradesperson who will represent us.
3. ESTIMATED QUOTES/ACTUALLY QUOTES
3.1 Estimated quote are free. Estimated quotes are based on the information provided by the customer for which the Company, after making all reasonable inquiries, depending on the scale of works cannot give a definite Price at the time. For a definite price depending on the scale of the works then an EICR would be required to determine scope of works what is required.
The total charge to you will be given as a firm cost (manifest errors exempted), inclusive of labour & materials. All costs include VAT.
Where a written estimate has been supplied to you, the total charge outlined in the estimate should not exceed the actual time taken by more than 20%, but may be revised in the following circumstances:

If, after submission of the estimate, you instruct us (in writing or verbally) to carry out additional work not referred to in the estimate.

If, after submission of the estimate, there is an increase in the price of materials.

If, after submission of the estimate, it is discovered that further work needs to be carried out which were not anticipated when the estimate was prepared.

If, after submission of the estimate, it is discovered that there was a manifest error when the estimate was prepared.
We will not be under any obligation to provide an estimate to you and will only be bound by estimates given in writing to you and signed by an authorised representative. We will not be bound by any estimates given orally or in which manifest errors occur.
4. ELECTRICAL EMERGENCY/FAULT FINDING:
4.1 Fees are made up front before arrival.
4.2 ETA are normally between 3-4hours this may vary depending on our availability.
4.3 This is not a first time fix service and excludes any materials, electrical emergencies/fault finding is an investigation service. Upon investigation if we are able to fix/repair whilst on-site with stocked materials, their will be a charge those materials used. Collection of non-stocked materials time will be kept to a minimum and within reason, if any unforeseen circumstances occur where collection time increase you will receive notification prior.
4.4 Domestic property call out charge Monday-Friday is £90.00 per hour and Weekend and Bank holidays £125.00 per hour. Business/Commercial premises call out charge Monday-Friday is £150per hour and Weekend and Bank holidays £250per hour.Call out fees apply per electrician attending on the day/night. If two electricians are needed to the required emergency call out an trainee will be use depending on availability to keep cost minimal.
4.5 If you decide not to go ahead with the emergency call out then administration cancellation fee of £35.00 will still apply and the remaining will be refund.
5. WORKS/REMEDIAL WORKS
5.1 All initial fees/payments are made up front before arrival.
5.1 No other trades/third parties are to interfere or tamper with any of the electrical installation wiring, electrical components or accessories installed by us, as this will effect guarantees, certification, notifiable works building control and any unmentioned documentation, works may also come to an stop because of these actions, if instructions have not been given by us.
5.3 Variations are chargeable and need to be made in writing awaiting approval by us.
5.1 All work carried out is in accordance to BS7671, no deviations will be made by us.
5.2 Any works incomplete by third parties, any unsatisfactory E.I.C.R’s by third parties in order to achieve a satisfactory report/certification would need an E.I.C.R carried out by us or by an representative of is, as we do not accept any third party E.I.C.R. as credible. All works carried out by us or an representative of us, will be left in a satisfactory condition that is safe and suitable for continuous use will result in having a satisfactory E.I.C.R or the appropriate certification.
5.3 Any works that may need to introduce new electrical equipment or electrical devices into the existing electrical installation to meet current regulations requirements, may bring out hidden faults that were on your existing electrical installation that your old equipment or devices would not detect. If this is the case we take no responsibility for any hidden/underlying faults.
6 INSPECTION AND TESTING
6.1 All initial fees/payments are made up front before arrival.
6.2 All inspection and testing to be carried all buildings/properties must have an live electric supply.The CU/DB/fusebox and electrical accessories must be accessible including DNO equipment for inspection and testing. Restricted to access CU/DB/fusebox or for any reason the inspection cannot be carried out where the engineer is not at fault will occur a call out charge. The power supply to the buildings/properties must be disconnected during the inspection and testing in order to carry out testing procedures.
6.3 E.I.C.R Extent and Limitations of inspection and testing covered by the reports: 100% of switchgear. Fixed installation only and observable parts, ideally 100% but not less than 25% of final circuits and 10% of accessories in accordance of 3.8.4 of GN3 as carrying out 100% inspection and testing in many installations is unrealistic, uneconomical and unachievable. Visual inspection only of observable parts, supplemented by appropriate testing procedures and measurements. No unnecessary dismantling of parts or accessories to disrupt or damage the building fabric.All Electrical intake cupboard that are not accessible to check characteristics of supply. No installation reference methods or number of points, if no installation records are provided or available. All appliances excluded and associated wiring. All unidentifiable circuits and any non defined circuit labels. No moving of furniture or white goods. No unnecessary disconnections/ removal of parts, accessories to avoid unsatisfactory reconnections. No loft space or out buildings inspected unless an agreement has been made and service paid for. No lifting or removing of floor boards/laminate, floor tiles, ceiling tiles for inspection unless already made accessible. Visual inspection only for off peak consumer unit unless an agreement has been made as outside operational working hours.
6.4 As recommended by BS7671 and GN3 satisfactory E.I.C.R’s recommendation for the next proposed date for next inspection is at change of occupancy/5years this may be subject to change by the electrician carrying out the subsequent inspections, may recommend that the interval between future inspections be increased or decreased as a result of the findings of their inspection. (E.I.C.R’s are not warranties or guarantees and are not valid for 5 years)
6.5 E.I.C.R‘s Domestic are based on one single phase consumer unit with the maximum of 10 circuits with a single phase supply. Any extra circuits are charged at an additional cost and any addition consumer units are charged at an additional cost also. Any Domestic properties with a three phase CU/DB will be classed as a commercial property not domestic.
6.6 E.I.C.R‘s Commercial are based on one single and/or three phase consumer/distribution board unit with the maximum of 20 circuits with a single and/or three phase supply. Any extra circuits are charged at an additional cost and any addition consumer units/distribution boards are charged at an additional cost.
6.7 We do not carry out any electrical remedial works whilst carrying out inspection and testing. All electrical appliances, electronic devices are excluded from this service unless an service has been paid for by the client ordering the works to testing and inspecting by means of P.A.T. We do not take any responsibility for any customers/tenants goods/belongings/appliances/devices if faulty or damaged.
6.8 Routine Check/End Of Tenancy Check services are only available only available for Landlords who have a satisfactory E.I.C.R that has not exceeded 5 years period.
6.6 Bespoke inspections and testing must be requested in writing.
6.7 Bespoke inspection and testing extent and limitations of inspection and testing and operational limitations including the reasons must be agreed by both parties.

6.9 Portable appliance test (P.A.T) all appliances need to be readily accessible with a plug and cables readily accessible for inspection and testing without the need to move the appliance or furniture. Appliances will not be inspected and tested if this is not the case.
6.10 If you are unable to keep the appointment please contact us to re-book the appointment via telephone as soon as possible. Cancellations made less than 24 Hours before the appointment will occur charge of £35.00.
Also where we:
-
Cannot gain access to property.
-
Wrong address was provided for inspection.
-
A child (under 18) is alone in the property.
-
No electrical supply.
-
No access electrical consumer unit.
-
Or for any reason the inspection cannot be carried out where the engineer is not at fault will occur a £75 fee per electrician and the remaining will be refunded.
Please note that all terms in this contract apply to any third party you instruct to be at a premises on your behalf
You are entitled to cancel, but no later than 24hrs before we are due to visit your property.

When you cancel an order, we will refund the price paid, within a period of 28 days from the date of cancellation.
7. CANCELLATIONS
Contract can be terminated or amended by the customer for any reason with in 3 days prior to commencement of the works. A fee of 15% of the total price will be made to cover administration costs and the return of any goods/materials to suppliers if required more than 3 working Days. (Excludes inspection and testing and emergency call out these have their own cancellation requirements)
8.PAYMENTS & INVOICES
Upon your agreement for us to carry out estimated/actual quoted work, a deposit payment of 50% of the total is payable immediately this amount will need to be received 1 week prior or sooner to the works commencing. We reserve the right to request full payment in advance at our discretion. Payment can be made via cash, credit or debit card. CHEQUES are not accepted.
Upon completion of work you will be invoiced, for which payment is due on receipt once payment has been cleared then all relevant documents will be released. We reserves the right to accrue and charge interest on any part of an invoice which remains unpaid at a rate of 8% over the base rate until payment is received by us in full.
You/the agreed party accept sole liability to make payment in full, unless you fully disclose when initially instructing us, to carry out work and/or supply materials that you are acting on behalf of a third party.
9.TIME KEEPING
If the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond our reasonable control: Act of God, explosion, flood, tempest, fire or accident; war, threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving our employees or of a third party); difficulty in obtaining materials, labour or machinery; and power failure or breakdown in machinery.
If we are unable to provide you with the services within a reasonable time due to circumstances outside our control, we shall either agree a new reasonable timescale with you for the service to be completed.
10. Guarantee
For your peace of mind, we provide a 12 month guarantee on labour carried out, in respect of faulty workmanship only. This is active from the date of completion of work, in addition to any manufacturer’s warranty/warranties. All products and materials are covered by their manufacturer’s standard warranty. However, the manufacturer’s warranty does not cover any labour cost for replacement products to be reinstalled.
The guarantee will become null & void if the work/appliance completed/supplied by us is:

Subject to misuse or negligence.

Repaired, modified or tampered with by anyone other than a 230 VOLTS tradespersons. We will accept no liability for, or guarantee suitability, materials supplied by you & will accept no liability for any consequential damage or fault.
We will not guarantee any work in respect of:

Any work undertaken on instruction from you and against the written or verbal advice of any tradesperson.
Work is only guaranteed in respect of work directly undertaken by us and with full payment having been made. Any non-related faults arising from recommended work which has not been undertaken by us will not be guaranteed.
Where we agree to carry out work on installations of inferior quality or over 10 years old no guarantee/warranty is given in respect of such work and we accept no liability in respect of the effectiveness of such work or otherwise.
11. Liability
We will only be liable for rectifying our own guaranteed work, and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested and not undertaken at the time.
We will not be held liable or responsible for any damage or defect resulting from work not fully guaranteed, or where recommended work has not been carried out. Work will not carry a guarantee where you have been notified by the tradesperson either verbally or indicated in ticked boxes or in our comments/recommendations.
We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such a delay is due to any cause beyond our reasonable control and we shall be entitled to reasonable time extensions.
We will be entitled to fully recover the costs or damages from any tradesperson whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of work.
12. COMPLAINTS
All complaints should be made in writing Your complaint will be acknowledged within three working days, fully investigated by the us, and you'll receive a full written response within 15 working days. Send your complaints to info@230volts.co.uk
13. TITLE TO GOODS
13.1. Title to any goods, supplied by us to the Customer, shall not pass to the Customer but shall be retained by the Company until full payment has been made.
13.2. The Company shall have absolute authority to repossess, sell or otherwise deal with or dispose of all any or part of such goods in which title remains vested in the Company.
13.3. For the purpose specified in (15.1) above, the Company or any of its agents or authorised representatives shall be entitled at any time and without notice to enter any premises in which goods or any part thereof are installed, stored or kept, or is reasonably believed so to be.
13.4. We shall be entitled to seek a court injunction to prevent the Customer from selling, transferring or otherwise disposing of such goods. Notwithstanding the foregoing, risk in such goods shall pass on delivery of the same to the Customer, and until such time as title in such goods has passed to the Customer, the Customer shall insure such goods to their replacement value and the Customer shall forthwith, upon request, provide the Company with a certificate or other evidence of such insurance.
These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.
These terms and conditions, and all contracts awarded between us and you, shall be governed and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English law.
